Ms Feinstein‘s health has been a topic of concern in recent years, with the Senate’s oldest member facing questions regarding her fitness to carry out duties. Although maintaining that she could fulfill her duties, the latest health crisis renewed the calls for her to resign before the end of her term. The calls grew from progressive Democrats, concerned that their legislative priorities would face barriers if Ms Feinstein continued in the position. Although Ms Feinstein has faced calls for resignation before, this time is different as the Senate is closely divided, and her absence could sway votes in this key political era.
The issue raises deeper questions about the effectiveness of Senate rules and procedures that don’t allow for replacements when a senator is unable to perform their duties adequately. Indeed, a 100-member Senate with a single vote majority counts on every senator to make their votes count. Additionally, debates around the need to institute term limits for Senators is coming up as much as ever. Overall, we should ask; what impact does the possibility of limited terms have on our democratic system? If a 100-member Senate with a single vote majority requires the physical presence of each senator for strategic action on approved legislation, then what provisions are there to cater to health emergencies? The Senate may need to readdress these issues to ensure a robust philosophy in executing the legislative responsibility.
In the meantime, Ms Feinstein‘s protocols to work on a lighter schedule will lessen some tension both for herself and the Democrats, eagerly waiting for their legislative priorities to be set on course. The resumption of her duties will not only strengthen the Senate and restore any disharmony that her absence had created but also strengthen the conversation about the need for new provisions to cater to health emergencies in the Senate. Indeed, the debate around legislation and senatorial protocols to cater to unique crises such as the current health crises, or other reasons that would require a senator’s absence, is perhaps timely and necessary.
